Department of Environmental Protection Notice of Nondiscrimination

The Maine Department of Environmental Protection (DEP) complies with Title VI of the Civil Rights Act of 1964, Title II of the Americans with Disabilities Act of 1990, Section 504 of the Rehabilitation Act of 1973, Title IX of the Educational Amendments of 1972, Age Discrimination Act of 1975, and the Maine Human Rights Act in the implementation of its programs.
DEP operates its programs, services and activities in compliance with applicable federal and state nondiscrimination laws.

Federal Laws

DEP complies with the following federal statutes and regulations:

  1. Title VI of the Civil Rights Act of 1964, 42 U.S.C. § 2000d, et seq. and all implementing regulations, which prohibits discrimination on the basis of race, color or national origin;
  2. Title II of the Americans with Disabilities Act of 1990, 42 U.S.C. § 12101, et seq. and all implementing regulations, which prohibits discrimination on the basis of disability;
  3. Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 701, et seq. and all implementing regulations, which prohibits discrimination on the basis of disability in any program or activity receiving federal financial assistance;
  4. Title IX of the Educational Amendments of 1972, 20 U.S.C. ch. 38 and all implementing regulations, which prohibits discrimination on the basis of sex in any educational program or activity receiving federal financial assistance.
  5. Age Discrimination Act of 1975, 42 U.S.C. § 6101, et seq. and all implementing regulations, which prohibits discrimination on the basis of age in any program or activity receiving federal financial assistance.
  6. Section 13 of the Federal Water Pollution Control Act Amendments of 1972, 33 U.S.C. § 1251, et seq. and all implementing regulations, which prohibits discrimination on the basis of sex in any program or activity receiving federal financial assistance under the Federal Water Pollution Control Act and the Environmental Assistance Act.
  7. 40 C.F.R. pt. 7, et seq., in which the United States Environmental Protection Agency implements the above listed acts and implementing regulations.

DEP also provides meaningful access to its programs, services, and activities to individuals with limited English proficiency, in compliance with US Environmental Protection Agency policy and Federal Executive Order 13166.

State Laws

DEP complies with the Maine Human Rights Act, 5 M.R.S. § 4551, et seq. and all implementing regulations, which prohibit discrimination in employment, housing or access to public accommodations on account of race, color, sex, sexual orientation, physical or mental disability, religion, ancestry or national origin, in education on account of sex, sexual orientation or physical or mental disability.

The Department will designate at least one employee to coordinate its efforts to comply with and carry out its responsibilities listed above.
