Board of Director's Meeting
November 19, 2004

A meeting of the Maine Motor Vehicle Franchise Board was held on Friday, November 19, 2004 in the Executive conference room at the Bureau of Motor Vehicles, 101 Hospital Street, Augusta, Maine.

Chairman John McCurry called the meeting to order at 9:10 a.m.

Roll Call

Present: John McCurry, Nelson Carlson, William Dowling, John Quirk, Sr., Carol Kontos.

Minutes:

After discussion of the revisions of MMVFB Rules 2 (3), 3 (1) B, and 4 (1) B, which the Chair sent to all Board Members on October 29, 2004, John Quirk Sr. moved and Carol Kontos seconded his motion to adopt the rules as
revised. The revised Rules were adopted by a unanimous Board.

Robert O'Connell, Jr. brought up that the rules would need to be filed with the Attorney General and the Secretary of State before any copies could be sent out. As soon as they are approved, copies need to be sent out to Darlings and Ford.

John McCurry discussed with the Board the pleading and hearing process, the standards of proof and evidence governing the Franchise Board, and the prohibition on ex parte communications.

The meeting adjourned at 11:14.
